1. Terms and conditions of use

1.1 Acceptance of terms: By accessing www.mortgagedeals.ie you accept these terms. If you do not accept these terms, you may not use www.mortgagedeals.ie

1.2 These terms and conditions may be ammended from time to time. Amendments will be deemed effective when posted on www.mortgagedeals.ie. You are responsible for ensuring you are familiar with our latest terms and conditions of use. Your continued use of www.mortgagedeals.ie represents your agreement to be bound by these terms as amended.

1.3 In these terms and conditions:

‘we’, ‘us’ and ‘our’ refer to Unique Internet Service Centre Ltd. (UISC)

‘you’ and ‘your’ refer to you and any other party to your application for mortgage.

www.mortgagedeals.ie means any UISC website, and includes our associated services and the software and other material underlying and forming part of the www.mortgagedeals.ie website or our services.

2. Our role

2.1 UISC is an Internet Marketing company offering a free advertising service to borrowers and a paid advertising service to lenders/brokers on our websites. UISC is NOT a mortgage broker or mortgage lender and passes all mortgage applications to acredited and fully regulated mortgage brokers only. UISC is not the sole agent, partner or other representative of any single lender, broker, intermediary or financial loan service provider. We have no authority to bind any lender or make any promise or statement on behalf of any lender/broker. Neither are we responsible for anything a lender/broker does or does not do.

2.2 We provide www.mortgagedeals.ie for you to use on these terms of use, including in particular the disclaimers and limitations of liability in clause 6. Once you choose a responding broker/lender you will deal directly them. UISC's role as an advertising agency ends at that point. We are not a party to any transaction or agreement you enter into with your chosen broker/lender.

3. Borrower rules

3.1 To use www.mortgagedeals.ie you must be an Irish resident aged 18 years or over or an EU company in each case seeking a Euro (€) residential home loan in Ireland.

3.2 All advertisments you publish (Moergage Applications) must be in good faith, with a genuine interest in obtaining a loan.

3.3 All information you provide through www.mortgagedeals.ie must be true, accurate, up to date and complete, and include all information reasonably required for a broker/lender to assess your request.

3.4 You decide which, if any, response you accept. We and registered brokers/lenders would expect you to proceed with an application process after you make your chosen selection.

3.5 the www.mortgagedeals.ie borrower advertising service is for use by genuine borrowers only and mortgage applications may not be made by brokers, financial advisers or other agents on behlaf or their clients. If you do use a broker, financial adviser or other agent to assist you in submitting a mortgage application via www.mortgagedeals.ie, you are solely responsible for any fee that broker/lender may charge you for those services and neither UISC nor any lender has any liability to you or the broker, financial adviser or other agent in that regard.

3.6 You must keep your username and password strictly confidential. If for any reason you believe that your login details may have been compromised you must immediately change your password and let us know of the problem by emailing our help desk.

3.7 The use of www.mortgagedeals.ie is a privilege not a right. We may in good faith, in our absolute discretion, at any time and without notice:

(a) cancel any mortgage application;

(b) bar any person from using www.mortgagedeals.ie, including, if we consider the person has breached these terms; or

(c) take any other action we consider desirable to protect the quality, security or integrity of www.mortgagedeals.ie, and you agree that you will only use www.mortgagedeals.ie as it is intended to be used.

4. Advertising Fees/Charges

There are absolutely no fees charged to ‘borrower’ members for advertising their loan requests by making a mortgage applicaion or for using other services supplied at www.mortgagedeals.ie. A small monthly fee is charged to subscribing broker/lender members for advertising their services on www.mortgagedeals.ie

5. Receiving Responses to your mortgage applications

5.1 All mortgage applications are submitted to regulated and acreditied brokers who are subscribing advertisers on www.mortgagedeals.ie only. These brokers will respond to mortgage applications directly. When you (borrower) choose a response You will then deal directly with that broker/lender.

5.2 Like you, a broker/lender is expected to honour their response but is not legally required to do so. Before entering into a loan a broker/lender may, among other things, seek to satisfy itself:

(a) that the material information in your application is accurate, up to date and complete and includes all information required for a lender to assess your application;

(b) as to your identity;

(c) that any express conditions of its proposal have been or can be satisfied; and

(d) that no material and adverse event has occurred since you lodged your request.

You acknowledge that the lender will rely on the information you provide.

5.3 You can post up to two mortgage applications using the same base terms (for example, for a fixed rate or both fixed and variable) at the same time. If you reject all the proposals on any single applicaion and submit another application for the same base terms we may inform brokers/lenders of that fact when providing your personal details. If you again reject all proposals and make anuther application for the same base terms and in short proximity, we reserve the right to suspend your use of www.mortgagedeals.ie.

5.4 In keeping with our policy of service development, we may change www.mortgagedeals.ie and its content at any time without notice.

6. Disclaimers and our liability

6.1
(a) We provide a service to you (the borrower) to ‘advertise’ your loan requirement by making a mortgage application using www.mortgagedeals.ie and request responses from brokers/lenders. UISC is not a mortgage broker or financial adviser and while our help desk can assist you to complete your mortgage application form on www.mortgagedeals.ie we do not offer or supply financial, professional or other advice (including whether any loan suits you). Nor do we check or verify any responses or information submited to you by subscribing brokers. After using www.mortgagedeals.ie and subsequently enter into any loan with any lending institution you need to take and rely solely on your own advice.

(b) We provide a service to you (the broker/lender) to ‘advertise’ your business to potential 'borrower' members for a small monthly fee. We make no charge to you for forwarding mortgage application details on behalf of a borrower. OUR ADVERTISING CHARGE APPLIES WHETHER OR NOT A 'BORROWER' MEMBER PROCEEDS WITH ANY SUBSEQUENT LOAN APPLICATION. We do not check or verify any information submited on www.mortgagedeals.ie by any 'borrower' member or make any claim as to their suitablity or credit worthiness.

6.2 www.mortgagedeals.ie uses a number of pre-defined simple performance and geopgraphic ranking formulae to select appropriate brokers/lenders to submit your (borrower) information to. We do not warrant the accuracy of the formulae or the results of applying them to your circumstances. None of our ranking formulae are a substitute for advice specific to your circumstances, and should not be relied on.

6.3 www.mortgagedeals.ie may include advertisements for, and information provided by, lenders and others. It may also include links to external sites. We do not control, review or endorse any advertised product or service, or linked external sites.

6.4 We do not guarantee any outcome from using www.mortgagedeals.ie. It is possible that your mortgage application does not receive any response acceptable to you (or any response at all) or that you choose a response from a broker/lender and they decide not to proceed with an application on your behalf.

6.5 www.mortgagedeals.ie is provided on an ‘as is’ and ‘as available’ basis. We cannot, and do not, warrant that www.www.mortgagedeals.ie will be uninterrupted, timely, secure or error free, or give any other specific performance guarantee relating to www.mortgagedeals.ie or its operation or use.

6.6 All warranties and representations implied by law are excluded to the fullest extent permitted by law.

6.7 You use www.mortgagedeals.ie at your own risk. Subject to complying with any duty we may have to exercise reasonable care and skill under Irish Consumer legislation, we will never in any circumstances be liable to you or any other person in contract, negligence or other tort, equity or in any other way for any loss or damage of any kind arising from your use of, or inability to use, www.mortgagedeals.ie, or any other website linked to www.mortgagedeals.ie.

If for any reason we cannot rely on the above exclusion of liability, our liability to you will be limited to EURO 50 and in no event will we be liable to you for any loss of profit, savings, goodwill or business opportunity or for any indirect or consequential loss.

7. Intellectual Property

We (and our licensors or suppliers, as applicable) own all copyright and other intellectual property rights in www.mortgagedeals.ie. We reserve all our rights.

You may download, print and store any part of www.mortgagedeals.ie for your personal non-commercial use. Otherwise, you may not in any form or by any means copy, reproduce, modify, create derivative works from, distribute, or publicly display anything from www.mortgagedeals.ie without our (and any applicable third party’s) prior written consent.

www.mortgagedeals.ie includes proprietary software. You may not copy, reproduce, reverse engineer or modify. The software may only be used for the purposes of accessing this website and listing requests for proposals in the manner provided.

You accept our Privacy Statement.

9. Other legal statements

9.1 Even though www.mortgagedeals.ie could be reffered to as an auction website, we are not auctioneers (under the Auctioneers Act or otherwise).

9.2 If any part of these terms of use are held to be invalid, unenforceable or illegal for any reason, then that part shall be severed or amended to the minimum extent necessary for the balance of these terms of use to continue in full force and effect.

9.3 Your obligations under these terms of use are also for the benefit of any lender whose proposal you accept.

9.4 These terms of use contain everything we have agreed in relation to your use of www.mortgagedeals.ie. You cannot rely on anything else said or done by us (or any of our representatives).

9.5 These Terms and the use of www.mortgagedeals.ie is governed by the laws of the Republic of Ireland. You agree to the jurisdiction of the Republic of Ireland courts.

10. Refund Policy (brokers/lenders)

Registering with and subscribing to services at www.mortgagedeals.ie sold on an as is basis with no guarantee of suitability or quality. As with all advertising and subsequent mortgage applications entered into or generated by our "borrower" members it is not possible to guarantee that a prospective borrower will complete your application process. Further, due tho the nature of this service there is no guarantee that the borrowing member has not already made an application directly to your organisation. We therefore do not offer any refunds of your monthly advertising charge in any month where mortgage applications have been sent to you. By using our services you specifically agree that the above is a normal and acceptable business risk and waive any right to a refund. We will however provide a refund of monthly advertising fee in a month where no mortgage application have been sent to you. Applications for monthly advertising fee refund must be made strictly within 30 days of the the end of that month.

11. Reward Claim (Borrowers)

To claim a €100 reward from USIC a borrower must:-
(a) submit a mortgage application using www.mortgagedeals.ie.
(b) receive a proposal from one of our registered brokers
(c) complete an mortgage application process with that broker
(d) sucessfully draw down their mortgage AND
(e) make a formal claim and provide witten confirmation to USIC by FAX.
